So if it's during picking phase of DotA or DotA LoD and not to choose a hero or picking skills is an act of not participating in the game. In game sense is that ruining the game for other players because in the DotA LoD case, choosing and picking your own skills is the very game itself for winning for yourself and your teammates. In a sense afking means to not participate in the game and you are game ruining yes?

AFK = "Away From Keyboard" = hero does not move, player does nothing.
Afk grieve = sit at fountain or at trees, does nothing, and moves to prevent being !kickafk (Extreme case of refusing to play)
Refuse to play/refuse to teamwork = farms at jungle too long while team clearly needs help, continues to stay away from team fights intentionally, and does not cooperate when team asks several times.

If player is not picking skills/hero, he will be considered afk, and therefore, should be kicked when !kickafk command becomes available.
If player is chatting while refusing to play/afk, bannable, yes.
