Any further thoughts:

No screens. Doubtful that lobby chat is getting saved, not sure though.
+ Not even sure if votekicking in lobby is banable (even if it might be abusive).

Abusing votekick: using !votekick to spam or when the victim has not done anything wrong

Not clear enough. One can't simply do anything wrong in a lobby, to be honest. At least nothing which is ban/kick-able.

The staff has access to the evidence needed to process this.

I don't see a difference between votekicks in lobby and ingame.
In both cases the votekick is only permitted if the user has done something wrong aka violated a rule.

2 votekicks were initiated at wincest. The first votekick seemed to have failed, however; their second votekick succeeded.

So yea those that votekick thought they had the last laugh (LOL). Here goes, the initiator of the votekick gets a 4 day ban off ent bot and those that !yes gets a 3 day ban. This is ban is NONAPPEALABLE. This should be funny when the appeals come in for it.
