You broke a rule, simple as that.
Go to our wiki and copy and paste the rule you broke in that game.

When using a mode other than the default one, the mode setter (red) has to announce it in the lobby before the game starts. Every player must be informed, so they have the opportunity to leave in case of dislike.

nobody had to announce it in the lobby before the game start if u ask maybe then say which mode

It is fair. The rule states that you must announce a different mode if you intend to play it. If you do not do so and pick the different mode once the game starts, then you can be reported and banned. Regardless of if you are asked or not, you must announce the mode if you intend to play a different one.

You still have to announce if you want to choose 'ac', as the mode is hpgmcb. Most don't report, but if reported, it is bannable without announcement.
