Overall, even when telling him what he does is bannable, he continues. He even tried building a lb after i told him not to and he left the base when votekick was started.

From what I saw, he ignored when you said to build an lb elsewhere the first time because he was busy telling the world he needed an lb. After a bit he built 2 and a half shelters. Once you told him to get out, he denied the shelters and left your base. Of course there was flame, but it wasn't excessive. From previous games with him, he is indeed a toxic player with a foul mouth, although it didn't actually take him long to follow your instructions. Basically I think that the offense wasn't so bad as to warrant a ban (It's not like he stayed in the base and carried on building etc...).

Considering the fact that ogre left after you told him to, I will not ban him for building in your base. And as for his flame it was borderline excessive, but you also did provoke him such as by saying stuff like "you mad?" so I am denying that request as well, but I will give him a warning. If you see him flaming in other games you can post another ban request.
