Any further thoughts:
He asked right before countdown if Hybrid was ok. I never agreed to it nor did he announce the mode at the beginning of the game as well

Technically, this is still regarded as an announced mode. I do believe though, it must be hpgmcb hybrid If he does not explicitly say hpgm. If you don't agree to it, you must leave the game, otherwise you agree upon the mode that is set.

You don't have to agree to the mode but sleeper should have been more clear with the mode.
